Terms & Conditions

Return and Exchange Policy

The buyer has the right to return or exchange the product within fourteen (14) days from the date of purchase, subject to the following conditions:

• The original purchase invoice must be presented.
• The product must be in its original condition, unused, and undamaged.
• Return or exchange will not be accepted for products that have been used, tampered with, or opened in a manner that affects their quality.
• In the event of a manufacturing defect or non-conformity with specifications, the consumer has the right to request a repair. If the seller is unable to carry out the repair, the equipment shall be replaced or the full amount paid shall be refunded, provided this occurs within the warranty period.

Warranty

The seller sells products under various brand names, which may result in differing warranty periods depending on the manufacturer.

• The seller undertakes to guarantee the sold goods against manufacturing defects or non-conformity to specifications for a period of twelve (12) months from the date of purchase, or as indicated on the warranty stamp or the original invoice, depending on whether the warranty period is longer or shorter.
• In the event a manufacturing defect appears during the warranty period, the Seller shall be obligated to repair or replace the product at no cost, subject to the approval of the Supplier or the Original Manufacturer. The Seller acts solely as an intermediary between them, and all procedures related to repair or replacement shall be subject to the authorization of the Supplier or Original Manufacturer.
• In the event that the product cannot be repaired or replaced, the consumer shall have the right to a full refund, subject to the approval of the Supplier or the Original Manufacturer, as the Seller acts solely as an intermediary between them.
• If the repair takes longer than fifteen (15) days, the seller shall provide the consumer with a similar product to use free of charge until the repair or replacement is completed.
• The seller is responsible for carrying out repairs during the warranty period in case of any defects.
• As the seller sells products from different brands, they act as an intermediary between the buyer and the product’s manufacturer; therefore, repair times may vary from one brand to another based on the manufacturer’s instructions

Spare Parts

The seller sells products under various brand names, which may result in differing availability of spare parts after the warranty period depending on the manufacturer.

• The seller is obligated to provide spare parts and maintenance services for durable goods for a period of three (3) years from the date of purchase.
• The seller is obligated to provide spare parts and maintenance services for non-durable goods for a period of one (1) year from the date of purchase, in accordance with the Qatari Consumer Protection Law.
• The seller acts as an intermediary between the buyer and the product manufacturer; therefore, the duration for providing spare parts may vary depending on the manufacturer’s instructions.

Periodic Maintenance and Responsibility for Spare Parts

• The Buyer shall be responsible for carrying out routine maintenance of the product at their own expense, both during and after the warranty period in accordance with the maintenance schedule and technical instructions issued by the Seller or the Manufacturer, as outlined in the catalog provided with the equipment.
• Failure by the Buyer to perform the required maintenance, misuse of the product or to comply with the specified technical guidelines shall constitute valid grounds for exclusion from the warranty coverage. In such cases, the Supplier shall be relieved of any obligation to repair or replace under the warranty.
• The Buyer shall bear all costs related to the replacement or repair of any worn-out or damaged parts resulting from normal wear and tear, misuse, or negligence, whether during the warranty period or thereafter, unless the defect is proven to be due to a manufacturing fault.
• Performing periodic maintenance or replacing damaged parts shall not result in any extension or renewal of the warranty period, unless explicitly stated otherwise in the product’s warranty terms.

Proper Usage

Some tools or devices sold may be hazardous or harmful if used improperly. Therefore:

• The buyer bears full responsibility for the safe and proper use of the product.
• The product must be used only for its intended purpose and in accordance with the operating instructions.
• The seller shall not be held liable for damages resulting from misuse or negligence.
• The buyer shall bear the costs of repairs and spare parts in cases of misuse or negligence.

Inspection and Notification

• The buyer acknowledges that they have inspected the product before purchase and received it in good condition and in conformity with specifications.
• If any defect or malfunction appears, the buyer must cease using the product and contact the authorized service center. Using non-original parts for repairs or unauthorized replacements may cause damage to the product, void the warranty, and pose a safety risk.
• It is the buyer’s responsibility to ensure that the product is suitable for the intended purpose before purchase.

Limitation of Seller’s Liability

• The consumer may also seek recourse against the manufacturer or the official agent if there is legal justification.
• The seller is considered an intermediary between the buyer and the manufacturer in the event of any dispute during the warranty period, in accordance with the Consumer Protection Law.

Installment / Credit

• The buyer is obliged to pay the installments on time. In case of delay of more than five (5) days from the due date, a late fee of up to 1% of the installment value per month of delay will be applied.
• Goods sold on installment remain the property of the seller until full payment is received.
• Delivery of the product shall be considered a conditional loan for use, subject to full payment.
• The buyer may not dispose of, relocate, or use the product for a purpose other than intended without written consent from the seller.
• In case of the buyer’s breach of payment terms, the seller has the right to repossess the product, evaluate it, and set off its value against the remaining balance, in compliance with the law.
• The seller’s records and official documents shall serve as the primary reference in establishing outstanding amounts.
• The buyer acknowledges that they have reviewed and accepted all terms related to the installment sale, including the cash price, installment price, number of installments, term, total cost, any down payment, and applicable interest. The buyer’s signature on this contract or on the credit facility application—whether permanent or temporary—constitutes an express acknowledgment of receiving all information related to the installment plan in accordance with the provisions of the Qatari Consumer Protection Law. The buyer confirms full commitment to pay the due installments on time and assumes full legal responsibility in the event of any breach of the agreement terms.

General Provisions

Force Majeure

The seller shall not be liable for any delay or failure to perform obligations due to events beyond their control, including but not limited to: such as natural disasters, supply chain disruptions, or emergency government regulations, or the outbreak of a global pandemic.

Dispute Resolution

Any disputes arising from this contract shall be referred to the Qatari courts or arbitration, at the seller’s discretion, in accordance with applicable laws. The decision shall be final and binding.

Language

This document is drafted in both Arabic and English. In the event of any conflict, the Arabic version shall prevail.

Images

Product images are provided for illustrative purposes only and may differ from the actual product in terms of color, appearance, or packaging due to factors such as lighting, screen settings, or manufacturer updates.
You acknowledge that the Company bears no liability for minor discrepancies between the images and the actual products, and that such images shall not be relied upon as grounds for any claim.

Products labeled as part of “Overstock Sale”
The Buyer expressly acknowledges and agrees that the products offered as and/or under the “Overstock Sale” category on the website or in the showroom may include old stock, discontinued items, or products without their original packaging. All such products are sold “as-is”, are deemed fit for sale unless otherwise stated, and are not covered by any warranties, whether express or implied, including but not limited to warranties against defects from the date of sale. The Company disclaims any liability for claims related to specifications, usage, or quality after the sale, and the Buyer acknowledges and accepts this disclaimer.

Spare Parts labeled as part of “Overstock Sale”
The Buyer expressly acknowledges and agrees that the spare parts offered as and/or under the “Overstock Sale” category are sold “as-is” and are not covered by any warranty from the date of sale, including but not limited to warranties against defects or fitness for a particular purpose.
The Buyer assumes full responsibility for inspecting the parts and ensuring their suitability prior to purchase and shall bear sole responsibility for any consequences arising from their use after the sale, including malfunctions, maintenance requirements, or replacement needs.

Acknowledgment

The buyer acknowledges that they have read and understood all the terms and conditions stated in this contract and may not claim ignorance thereof at a later time.

Legal Compliance

Both parties shall comply with the provisions of Qatari Consumer Protection Law No. (8) of 2008 and its amendment No. (14) of 2011.

شروط وأحكام المبيعات

الإرجاع والاستبدال

يحق للمشتري إرجاع أو استبدال السلعة خلال أربعة عشر (14) يومًا من تاريخ الشراء، وذلك وفقًا للشروط التالية:

• يجب تقديم فاتورة الشراء الأصلية.
• يجب أن تكون السلعة في حالتها الأصلية، غير مستخدمة، وغير متضررة.
• لا يُقبل الإرجاع أو الاستبدال للمنتجات التي تم استخدامها أو العبث بها، أو التي تم فتحها بطريقة تؤثر على جودتها.
• في حال وجود عيب مصنعي أو عدم مطابقة للمواصفات، يحق للمستهلك المطالبة بالإصلاح. وإذا تعذّر على البائع إجراء الإصلاح، يتم استبدال المعدة أو إعادة كامل المبلغ المدفوع، وذلك خلال فترة الضمان.

الضمان

البائع يقوم ببيع منتجات تحمل علامات تجارية مختلفة وذلك قد يؤدي إلى اختلاف مدة الضمان لكل منتج وفقًا للشركة المصنعة له

• يلتزم البائع بضمان السلع المُباعة ضد العيوب المصنعية أو عدم المطابقة للمواصفات، وذلك لمدة اثني عشر (12) شهرًا من تاريخ الشراء، أو طبقًا لختم الضمان أو المدة الموضحة على الفاتورة الأصلية في حال زيادة أو نقصان مدة الضمان.
• في حال ظهور عيب مصنعي خلال فترة الضمان، يلتزم البائع بإصلاح المنتج أو استبداله دون أي مقابل، وذلك بعد الحصول على موافقة المورد أو المصنع الأصلي، باعتبار أن البائع يعمل كوسيط فقط بينهما، وتكون جميع الإجراءات المتعلقة بالإصلاح أو الاستبدال خاضعة لاعتماد المورد أو المصنع الأصلي.
• في حال تعذّر إصلاح المنتج أو استبداله، يحق للمستهلك استرداد كامل المبلغ المدفوع، وذلك بعد الحصول على موافقة المورد أو المصنع الأصلي، باعتبار أن البائع يعمل كوسيط فقط بينهما.
• في حال تعذر الإصلاح مدة تجاوز خمسة عشر يوماً، التزم البائع بتوفير سلعة مماثلة للمستهلك يستخدمها دون مقابل إلى أن يتم الإصلاح أو الاستبدال.
• يلتزم البائع بالإصلاح خلال فترة الضمان في حال ظهور عيب فيها.
• البائع يقوم ببيع منتجات تحمل علامات تجارية مختلفة ؛ ولذلك فهو يعد وسيطًا بين المشتري والشركة المصنعة للمنتج وبناءً عليه قد تختلف مدة إصلاح المنتج من علامة تجارية إلى علامة تجارية أخرى وفقًا لتعليمات الشركة المصنعة للمنتج.

قطع الغيار

البائع يقوم ببيع منتجات تحمل علامات تجارية مختلفة وذلك قد يؤدي إلى اختلاف توافر قطع الغيار لكل منتج بعد انتهاء فترة الضمان وفقًا للشركة المصنعة له.

• يلتزم البائع بتوفير قطع الغيار وخدمات الصيانة للسلع المعمرة لمدة ثلاث سنوات من تاريخ الشراء.
• يلتزم البائع بتوفير قطع الغيار وخدمات الصيانة للسلع غير المعمرة لمدة سنة من تاريخ الشراء، وذلك وفقًا لقانون حماية المستهلك القطري.

• البائع يقوم ببيع منتجات تحمل علامات تجارية مختلفة ؛ ولذلك فهو يعد وسيطًا بين المشتري والشركة المصنعة للمنتج وبناءً عليه قد تختلف مدة توفير قطع الغيار للمنتج من علامة تجارية إلى علامة تجارية أخرى وفقًا لتعليمات الشركة المصنعة للمنتج.

الصيانة الدورية والمسؤولية عن قطع الغيار

• يلتزم المشتري بإجراء الصيانة الدورية للمنتج على نفقته الخاصة وذلك أثناء فترة الضمان وبعد انتهائها، وذلك وفقًا للجدول الزمني والتعليمات الفنية الصادرة عن البائع أو الشركة المصنعة كما هو موضح في الكتيب (الكاتالوج) المرفق مع المعدة.
• يُعد إهمال المشتري في تنفيذ الصيانة الدورية، أو سوء استخدام المنتج،أو عدم الالتزام بالتعليمات الفنية سببًا مبررًا لسقوط حقه في الضمان، ويُعفي البائع من أي التزام متعلق بالإصلاح أو الاستبدال بموجب الضمان.
• يتحمل المشتري كافة التكاليف المترتبة على استبدال أو إصلاح أي أجزاء متهالكة أو تالفة نتيجة الاستهلاك الطبيعي أو سوء الاستخدام أو الإهمال، سواء أكان ذلك خلال فترة الضمان أو خارجها، ما لم يثبت أن العيب ناتج عن خلل أو عيب مصنعي.
• لا يُعدّ إجراء الصيانة الدورية أو استبدال الأجزاء التالفة سببًا في تمديد أو تجديد فترة الضمان، ما لم يُنص على خلاف ذلك صراحةً في شروط الضمان الخاصة بالمنتج،

الاستخدام السليم

بعض الأدوات أو الأجهزة المباعة خطرة و مؤذية عند الاستعمال الخاطئ لها ، لذلك:

• يتحمل المشتري المسؤولية الكاملة عن الاستخدام السليم والآمن للمنتج.
• يجب استخدام المنتج فقط وفق الغرض المصمم له وبما يتوافق مع تعليمات التشغيل.
• لا يتحمل البائع آية مسؤولية عن الأضرار الناتجة عن سوء الاستخدام أو الإهمال.
• يتحمل المشتري تكاليف التصليح وقطع الغيار في حال تبيّن وجود سوء استخدام أو إهمال.

المعاينة والتنبيه

• يقر المشتري بأنه قد عاين السلعة قبل الشراء وتسلّمها بحالة سليمة مطابقة للمواصفات.
• في حال ظهور أي عيب أو خلل في المنتج، يجب التوقف عن استخدامه والتواصل مع مركز الخدمة المعتمد؛ وذلك لأن استبدال أو إصلاح المنتج بقطع غير أصلية قد يسبب ضررًا أو تلفًا للمنتج ويؤدي ذلك إلى انتهاء الضمان ، وقد يُعد ذلك خطرًا في الاستخدام.
• تقع على المشتري مسؤولية التأكد من أن المنتج مناسب للغرض المقصود قبل الشراء.

حدود مسؤولية البائع

• يمكن للمستهلك أيضًا الرجوع على الشركة المصنعة أو الوكيل الرسمي في حال وجود مبرر قانوني.
• يعد البائع وسيطًا بين المشتري والشركة المصنعة في حالة نشوب أي خلاف أو نزاع أثناء فترة الضمان طبقًا لقانون حماية المستهلك.

سياسة البيع بالتقسيط

• يلتزم المشتري بسداد الأقساط في مواعيدها. وفي حال التأخير لأكثر من خمسة (5) أيام من تاريخ الاستحقاق، تُطبق غرامة تأخير لا تتجاوز 1% من قيمة القسط عن كل شهر تأخير.
• تظل البضائع المباعة بالتقسيط مملوكة للبائع حتى سداد كامل المبلغ المستحق.
• يُعتبر تسليم السلعة بمثابة عارية استعمال مشروطة بالسداد.
• لا يجوز للمشتري التصرف في السلعة أو تغيير مكانها أو استخدامها لغرض غير مخصص لها دون موافقة كتابية من البائع.
• في حال إخلال المشتري بشروط السداد، يحق للبائع استرداد السلعة، وتقييمها، وإجراء مقاصة بين قيمتها وما تبقى من المستحقات، مع احترام أحكام القانون.
• تعتبر سجلات البائع والمستندات الرسمية المرجع الأساسي في إثبات المستحقات.
• يقر المشتري بأنه اطلع ووافق على الشروط الخاصة بعملية البيع بالتقسيط، بما يشمل السعر النقدي وسعر البيع بالتقسيط، وعدد الأقساط، ومدتها، والتكلفة الإجمالية، وأي دفعة مقدمة أو فوائد مترتبة، ويُعتبر توقيعه على هذا العقد أو على طلب فتح التسهيلات سواء كانت دائمة أو مؤقتة بمثابة إقرار صريح باستلامه كافة البيانات المتعلقة بالتقسيط وفقًا لما تنص عليه أحكام قانون حماية المستهلك القطري ، ويؤكد المشتري التزامه التام بسداد الأقساط المستحقة في مواعيدها، وتحمله المسؤولية القانونية الكاملة في حال الإخلال بأي من شروط هذا الاتفاق.

 

أحكام عامة

 

تسوية النزاعات

تُحال النزاعات الناشئة عن هذا العقد إلى القضاء القطري أو إلى التحكيم، حسب اختيار البائع، وطبقًا للقوانين السارية. ويُعد الحكم الصادر ملزمًا ونهائيًا.

اللغة

تم تحرير هذه الوثيقة باللغتين العربية والإنجليزية، وفي حال التعارض تسود النسخة العربية.

صوراﻟﻣﻧﺗﺟﺎت

ﺗُﻌرض ﺻور اﻟﻣﻧﺗﺟﺎت ﻷﻏراض اﻟﺗوﺿﯾﺢ ﻓﻘط، وﻗد ﺗﺧﺗﻠف ﻋن اﻟﻣﻧﺗﺞ اﻟﻔﻌﻠﻲ ﻓﻲ اﻟﻠون أو اﻟﻣظﮭر أو اﻟﺗﻐﻠﯾف ﺑﺳﺑب ﻋواﻣل ﻣﺛل اﻹﺿﺎءة أو إﻋدادات اﻟﺷﺎﺷﺔ أو ﺗﺣدﯾﺛﺎت اﻟﺷرﻛﺔ اﻟﻣﺻﻧﻌﺔ.
ﺗُﻘرّ ﺑﺄن اﻟﺷرﻛﺔ ﻻ ﺗﺗﺣﻣل أي ﻣﺳؤوﻟﯾﺔ ﻋن اﺧﺗﻼﻓﺎت طﻔﯾﻔﺔ ﺑﯾن اﻟﺻور واﻟﻣﻧﺗﺟﺎت اﻟﻔﻌﻠﯾﺔ، وﻻ ﯾﻣﻛن اﻻﻋﺗﻣﺎد ﻋﻠﻰ اﻟﺻور ﻛﺄﺳﺎس ﻷي ﻣطﺎﻟﺑﺔ. 

اﻟﻣﻧﺗﺟﺎت ﺿﻣن ﻓﺋﺔ “بيع فائض المخزون”

ﯾُﻘرّ اﻟﻣﺷﺗري وﯾواﻓﻖ ﺻراﺣﺔ ً ﺑﺄن اﻟﻣﻧﺗﺟﺎت اﻟﻣﻌروﺿﺔ ﺗﺣت ﻓﺋﺔ “بيع فائض المخزون” ﻋﻠﻰ اﻟﻣوﻗﻊ اﻹﻟﻛﺗروﻧﻲ أو ﻓﻲ اﻟﻣﻌرض ﻗد ﺗﺷﻣل ﻣﺧزوﻧﺎً ﻗدﯾﻣﺎً، أو ﻣﻧﺗﺟﺎت ﻣﺗوﻗﻔﺔ ﻋن اﻹﻧﺗﺎج، أو ﺑدون ﺗﻐﻠﯾﻔﮭﺎ اﻷﺻل .وﺗُﺑﺎع ﺟﻣﯾﻊ ھذه اﻟﻣﻧﺗﺟﺎت ﺑﺣﺎﻟﺗﮭﺎ ﻛﻣﺎ ھﻲ وھﻲ ﺻﺎﻟﺣﺔ ﻟﻠﺑﯾﻊ ﻣﺎ ﻟم ﯾُذﻛر ﺧﻼف ذﻟك وأﻧﮭﺎ ﻏﯾر ﻣﺷﻣوﻟﺔ ﺑﺄي ﺿﻣﺎن، ﺻرﯾﺢ أو ﺿﻣﻧﻲ، ﺑﻣﺎ ﻓﻲ ذﻟك اﻟﺿﻣﺎن ﺿد اﻟﻌﯾوب ﻣن ﺗﺎرﯾﺦ اﻟﺑﯾﻊ، وﺗُﺧﻠﻲ اﻟﺷرﻛﺔ ﻣﺳؤوﻟﯾﺗﮭﺎ ﻋن أي ﻣطﺎﻟﺑﺎت ﺗﺗﻌﻠﻖ ﺑﺎﻟﻣواﺻﻔﺎت أو اﻻﺳﺗﺧدام أو اﻟﺟودة ﺑﻌد اﻟﺑﯾﻊ ﻛﻣﺎ ﯾُﻘرّ اﻟﻣﺷﺗري ﺑذﻟك.

ﻗطﻊ اﻟﻐﯾﺎر ﺿﻣن ﻓﺋﺔ “بيع فائض المخزون”

ﯾُﻘرّ اﻟﻣﺷﺗري وﯾﻮاﻓﻖ ﺻﺮاﺣﺔ ً ﺑﺄن ﻗطﻊ اﻟﻐﯾﺎر اﻟﻣﻌروﺿﺔ ﺿﻣن ﻓﺋﺔ “بيع فائض المخزون” ﺗُﺑﺎع ﻛﻣﺎ ھﻲ وﻏﯾر ﻣﺷﻣوﻟﺔ ﺑﺄي ﺿﻣﺎن ﻣن ﺗﺎرﯾﺦ اﻟﺑﯾﻊ، ﺑﻣﺎ ﻓﻲ ذﻟك اﻟﺿﻣﺎن ﺿد اﻟﻌﯾوب أو ﺻﻼﺣﯾﺔ اﻻﺳﺗﺧدام.

وﯾﺗﺣﻣل اﻟﻣﺷﺗري ﻛﺎﻣل اﻟﻣﺳؤوﻟﯾﺔ ﻋن ﻓﺣص اﻟﻘطﻊ واﻟﺗﺄﻛد ﻣن ﻣﻼءﻣﺗﮭﺎ ﻗﺑل اﻟﺷراء، ﻛﻣﺎ ﯾﺗﺣﻣل وﺣده ﺟﻣﯾﻊ اﻟﺗﺑﻌﺎت اﻟﻧﺎﺗﺟﺔ ﻋن اﺳﺗﺧداﻣﮭﺎ ﺑﻌد اﻟﺑﯾﻊ، ﺑﻣﺎ ﻓﻲ ذﻟك اﻷﻋطﺎل أو اﻟﺣﺎﺟﺔ ﻟﻠﺻﯾﺎﻧﺔ أو اﻻﺳﺗﺑدال.

الإقرار

يقر المشتري بأنه قرأ وفهم جميع الشروط والأحكام الواردة في هذا العقد، ولا يجوز له الادعاء بجهلها لاحقًا.

الالتزام القانوني

يلتزم الطرفان بأحكام قانون حماية المستهلك القطري رقم (8) لسنة 2008 وتعديله رقم (14) لسنة 2011.

By purchasing items from “Makita Qatar Online store” or “Makita in Qatar” or “Makita.qa”, the purchasing individual/entity “Purchaser” hereby confirms and agrees to the following Terms and Conditions.

Makita Qatar Online store makes no guarantees or warrants that purchased items will be identical to depicted images. Purchaser shall not rely on images when placing an order, and shall review full product details/description. Makita Qatar Online store shall in no way be responsible for any variation from the product image to the delivered item. Information accuracy and availability of Products

Special Item(s) and/or Special Order(s)

Makita Qatar Online store shall use its best endeavors to show accurate inventory status for its products. Purchaser confirms that certain items may be cataloged as ‘Special Item’, and may only be purchased through ‘Special Order’ as provided for in this Clause 4. Special Item(s) and/or Special Order(s) shipments may vary depending on the manufacturer or any other third party.

Purchaser acknowledges and agrees that Special Item(s) and Special Order(s) are not guaranteed to be delivered within a communicated time frame. For the avoidance of doubt, communicated delivery times are estimates only, and will only be treated as such. Purchaser confirms that Special Item(s) and Special Order(s) must first arrive at Makita Qatar Online store warehouse from a manufacturer or other third party before being shipped to the Purchaser. Products

Purchaser shall use Ordered Products safely, properly, and in accordance with the general safety rules. Purchaser acknowledges that machines and equipment have limited support lives. As such, some items and/or some parts may be discontinued for reasons, such as but not limited to, manufacturer sole discretion, Makita Qatar Online store discretion, and/or government regulation, laws or directives. Purchaser is advised that manufacturers may not have certain products in stock. As such, currently unavailable items are considered ‘Back Order Item’.

Price Policy

Prices displayed on Makita Qatar Online store are subject to change at any time, in Makita Qatar Online store sole discretion, and without any prior notice.

Warranty

Makita Qatar Online store will endeavor to transfer to the Purchaser the benefit of any warranty or guarantee given by the manufacturer of Goods. Not all Goods are supplied with a manufacturer’s guarantee and guarantees which may be provided by manufacturers will vary in duration. It is the Purchaser’s responsibility to check at the time of purchase as to the applicability of the guarantee and/or the terms of any manufacturer’s guarantee. Where Makita Qatar Online store’s guarantee is provided, then it shall, free of charge, repair or, at its sole discretion, replace Ordered Items or, in the case of Services, re-perform Services which are proved to the reasonable satisfaction of Makita Qatar Online store to be damaged or defective due to faulty materials, workmanship or design. If the Ordered Items are found by Makita Qatar Online store not to be damaged or defective then Makita Qatar Online store will be entitled to return the Ordered Items to the Purchaser at the Purchaser’s sole expense. Software programs are supplied on the strict understanding that Makita Qatar Online store does not warrant their function to be free from defects or error.

Ordered Items shall be subject to manufacturer warranty, where available and applicable.

Indemnity

Purchaser shall indemnify and hold harmless Makita Qatar Online store, its officers, directors, employees, agents and shareholders from and against any costs, damages or other expenses that are payable (including costs of litigation and reasonable attorneys’ fees) arising out of any claims by Purchaser or any third party relating to services, products, Special Item, Special Order (for the purpose of this Clause 6 referred to as Ordered Items), including but not limited to infringements on any copyright, patent, trademark, trade secret, or other intellectual property right, or use of Ordered Items for illegal or prohibited purposes, or damages arising out of or attributable to improper use of Ordered Items.

The Purchaser shall indemnify Makita Qatar Online store for any losses resulting from gross negligence, recklessness, improper use of Ordered Items on the Purchaser’s part.

“Buy Now, Pay Later” service

Makita in Qatar’s “Buy Now, Pay Later” facility is offered through PayLater Company which determines applications’ acceptance or rejection, as the application will be subject to detailed evaluation according to each PayLater Company’s own policy.

Payment split might be on 4 without non-equal splits based on customer’s credit history and credit score.

Minimum purchase value is QR 300 and maximum purchase value is QR 25,000.

Items bought with PayLater can’t be refunded in cash.

Return and Exchange Policy

The buyer has the right to return or exchange the product within fourteen (14) days from the date of purchase, subject to the following conditions:

• The original purchase invoice must be presented.
• The product must be in its original condition, unused, and undamaged.
• Return or exchange will not be accepted for products that have been used, tampered with, or opened in a manner that affects their quality.
• In the event of a manufacturing defect or non-conformity with specifications, the consumer has the right to request a repair. If the seller is unable to carry out the repair, the equipment shall be replaced or the full amount paid shall be refunded, provided this occurs within the warranty period.

Warranty

The seller sells products under various brand names, which may result in differing warranty periods depending on the manufacturer.

• The seller undertakes to guarantee the sold goods against manufacturing defects or non-conformity to specifications for a period of twelve (12) months from the date of purchase, or as indicated on the warranty stamp or the original invoice, depending on whether the warranty period is longer or shorter.
• In the event a manufacturing defect appears during the warranty period, the Seller shall be obligated to repair or replace the product at no cost, subject to the approval of the Supplier or the Original Manufacturer. The Seller acts solely as an intermediary between them, and all procedures related to repair or replacement shall be subject to the authorization of the Supplier or Original Manufacturer.
• In the event that the product cannot be repaired or replaced, the consumer shall have the right to a full refund, subject to the approval of the Supplier or the Original Manufacturer, as the Seller acts solely as an intermediary between them.
• If the repair takes longer than fifteen (15) days, the seller shall provide the consumer with a similar product to use free of charge until the repair or replacement is completed.
• The seller is responsible for carrying out repairs during the warranty period in case of any defects.
• As the seller sells products from different brands, they act as an intermediary between the buyer and the product’s manufacturer; therefore, repair times may vary from one brand to another based on the manufacturer’s instructions

Spare Parts

The seller sells products under various brand names, which may result in differing availability of spare parts after the warranty period depending on the manufacturer.

• The seller is obligated to provide spare parts and maintenance services for durable goods for a period of three (3) years from the date of purchase.
• The seller is obligated to provide spare parts and maintenance services for non-durable goods for a period of one (1) year from the date of purchase, in accordance with the Qatari Consumer Protection Law.
• The seller acts as an intermediary between the buyer and the product manufacturer; therefore, the duration for providing spare parts may vary depending on the manufacturer’s instructions.

Periodic Maintenance and Responsibility for Spare Parts

• The Buyer shall be responsible for carrying out routine maintenance of the product at their own expense, both during and after the warranty period in accordance with the maintenance schedule and technical instructions issued by the Seller or the Manufacturer, as outlined in the catalog provided with the equipment.
• Failure by the Buyer to perform the required maintenance, misuse of the product or to comply with the specified technical guidelines shall constitute valid grounds for exclusion from the warranty coverage. In such cases, the Supplier shall be relieved of any obligation to repair or replace under the warranty.
• The Buyer shall bear all costs related to the replacement or repair of any worn-out or damaged parts resulting from normal wear and tear, misuse, or negligence, whether during the warranty period or thereafter, unless the defect is proven to be due to a manufacturing fault.
• Performing periodic maintenance or replacing damaged parts shall not result in any extension or renewal of the warranty period, unless explicitly stated otherwise in the product’s warranty terms.

Proper Usage

Some tools or devices sold may be hazardous or harmful if used improperly. Therefore:

• The buyer bears full responsibility for the safe and proper use of the product.
• The product must be used only for its intended purpose and in accordance with the operating instructions.
• The seller shall not be held liable for damages resulting from misuse or negligence.
• The buyer shall bear the costs of repairs and spare parts in cases of misuse or negligence.

Inspection and Notification

• The buyer acknowledges that they have inspected the product before purchase and received it in good condition and in conformity with specifications.
• If any defect or malfunction appears, the buyer must cease using the product and contact the authorized service center. Using non-original parts for repairs or unauthorized replacements may cause damage to the product, void the warranty, and pose a safety risk.
• It is the buyer’s responsibility to ensure that the product is suitable for the intended purpose before purchase.

Limitation of Seller’s Liability

• The consumer may also seek recourse against the manufacturer or the official agent if there is legal justification.
• The seller is considered an intermediary between the buyer and the manufacturer in the event of any dispute during the warranty period, in accordance with the Consumer Protection Law.

Installment / Credit

• The buyer is obliged to pay the installments on time. In case of delay of more than five (5) days from the due date, a late fee of up to 1% of the installment value per month of delay will be applied.
• Goods sold on installment remain the property of the seller until full payment is received.
• Delivery of the product shall be considered a conditional loan for use, subject to full payment.
• The buyer may not dispose of, relocate, or use the product for a purpose other than intended without written consent from the seller.
• In case of the buyer’s breach of payment terms, the seller has the right to repossess the product, evaluate it, and set off its value against the remaining balance, in compliance with the law.
• The seller’s records and official documents shall serve as the primary reference in establishing outstanding amounts.
• The buyer acknowledges that they have reviewed and accepted all terms related to the installment sale, including the cash price, installment price, number of installments, term, total cost, any down payment, and applicable interest. The buyer’s signature on this contract or on the credit facility application—whether permanent or temporary—constitutes an express acknowledgment of receiving all information related to the installment plan in accordance with the provisions of the Qatari Consumer Protection Law. The buyer confirms full commitment to pay the due installments on time and assumes full legal responsibility in the event of any breach of the agreement terms.

General Provisions

Force Majeure

The seller shall not be liable for any delay or failure to perform obligations due to events beyond their control, including but not limited to: such as natural disasters, supply chain disruptions, or emergency government regulations, or the outbreak of a global pandemic.

Dispute Resolution:

Any disputes arising from this contract shall be referred to the Qatari courts or arbitration, at the seller’s discretion, in accordance with applicable laws. The decision shall be final and binding.

Language

This document is drafted in both Arabic and English. In the event of any conflict, the Arabic version shall prevail.

Acknowledgment

The buyer acknowledges that they have read and understood all the terms and conditions stated in this contract and may not claim ignorance thereof at a later time.

Legal Compliance

Both parties shall comply with the provisions of Qatari Consumer Protection Law No. (8) of 2008 and its amendment No. (14) of 2011.
